It happens frequently – I get the call from a distraught parent or spouse, reporting that their loved one has been detained by Immigration because of an illegal substance like marijuana.
A noncitizen is at risk for simply admitting to an Immigration Officer that she possessed marijuana, even if it is legal in the State where she possessed it.
Currently, there are 9 States where it is legal to have recreational marijuana and medical marijuana is legal in 29 States, but it is NOT legal for a noncitizen in the U.S. At least, NOT until the Federal law changes.
Family members need to know that there are very serious consequences to using, possessing, or even ADMITTING to trying a controlled substance.
It is a trap for the uninformed – so parents, do your job and inform your teenagers! Even if your family member is a Permanent Resident, when applying for citizenship, the whole criminal history will be reviewed, including the possible connection to marijuana.
